Civil Division and BMV Appeals
The Ohio Bureau of Motor Vehicles (BMV) suspends Ohio driver licenses for a number of reasons, including:
| • Administrative license suspension (ALS) for pending/current OVI in court OTHER THAN Kettering Municipal Court (for OVI in Kettering Court, privileges are handled through the traffic case • Driving without insurance (Non-compliance suspension) • Receiving 12 points for accumulated traffic violations • Out-of-State alcohol- or drug-related offenses • Seeking BMV reinstatement fee payment plan |
The BMV will keep a suspension in effect until all of the associated reinstatement fees are paid.
If your license is suspended by the BMV for any of the above reasons, you can file a request to gain driving privileges during your suspension through the Clerk’s Office Civil Division. You can also make payment arrangements to pay off your reinstatement fees when you request privileges through our Court. (Please note: If you are under a suspension for failure to pay child support or a judgment suspension, these privileges cannot be requested through our Court. Please contact the Ohio BMV for more information regarding these types of suspensions.)
A request for driving privileges can be filed in person in the Clerk’s Office Monday through Friday, 8:00 a.m. to 4:30 p.m. Once you turn in the appropriate paperwork and pay your filing fee, your request will be assigned to a judge. The Civil Division has forms on hand for your (pro se) use. Typically, the judge may grant up to a maximum of 12 hours a day/5 days or 10 hours a day/6 days per week of driving privileges IF REQUIRED for work, school, family needs or medical treatment/counseling – if determined to be reasonable by the judge. You will be contacted by someone in the Civil Division once the privileges are signed or if the judge requires that you come in for a hearing.
