If your vehicle was seized or towed during a traffic stop or arrest, you will need to contact the law enforcement agency which cited you. They will advise you on whether the vehicle can be released or if a court order will be required to release it. Alternatively, you may also call the Assignment Office at 937-296-2466 to make sure that a court order is even needed as often times it is not necessary.
If a court order is required, you can come to the Court’s Assignment Office to fill out and submit a Request for Vehicle Release Form. Please bring proof of vehicle ownership in the form of your current registration or title and proof of insurance for the vehicle. A judge will consider your request and, depending on the offense you are charged with, will do one of three things based on what the law requires for the offense you are charged with:
• Upon payment of all storage and towing fees, release your vehicle and plates to you. • Upon payment of all storage and towing fees, release your vehicle and plates to you, but order it towed to your residence and immobilized—which means the vehicle cannot be driven for a specified period of time. • Release your vehicle and plates to you, but require that the vehicle be available on the date of final disposition of your case and order you not to sell, transfer or encumber the vehicle until further order of the Court. |
It may take up to 48 hours for you to receive a judge’s decision on your application.
Please be aware: If your vehicle was immobilized, the Clerk’s Office must notify the Ohio Bureau of Motor Vehicles (BMV). The BMV will charge you a fee to reinstate your vehicle registration.
