Filing an Appeal to the Ohio Second District Court of Appeals Through Kettering Municipal Court 

Your notice of appeal for a case tried in the Kettering Municipal Court (KMC) must be filed with the KMC Clerk of Court. Generally, you have 30 days from the file date of the final judgment to file your notice of appeal. See the Ohio Rules of Appellate Procedure for more information.

According to the Ohio Second District Court of Appeals, to start an appeal, you need to file a Notice of Appeal.  In addition, the Ohio Second District Court of Appeals states that you must also file either a Civil Docket Statement or a Criminal Docket Statement, and time-stamped copy of the final judgment being appealed (attach to your docket statement).

A sample notice of appeal and docket statement form(s) are available for download at the Court of Appeals website, along with court rules and other information. Additionally, you may choose to use this Notice of Appeal form for your convenience. Please be aware that the Clerk’s Office is unable to give you any advice on how to fill out these forms. We will simply process what you would like to submit for filing.

Once you have the required documents completed, please be aware of the following costs that need to accompany the appeal:


$100 deposit  –  check or money order made out to the Montgomery County Clerk of Court
$25 local court cost –  check or money order made out to Kettering Municipal Court
NOTE:  cash and credit card are accepted for the local court cost (credit card transaction fee applies)
